1. Introduction & Platform Role
Welcome to Timber. By accessing or using our platform, you agree to be bound by these Terms of Service. Timber operates exclusively as a software-as-a-service (SaaS) technology provider and marketplace infrastructure. We supply the tooling, bot automation, dashboards, and checkout systems that allow independent creators and server owners ("Vendors") to manage their digital commerce. We are not a party to the transactions between buyers and Vendors, we do not inspect or control the products sold, and we bear no responsibility for third-party digital deliverables, external assets, or customer disputes.
2. Vendor & User Responsibilities
Vendors utilizing Timber to sell products (such as Discord roles, digital files, software keys, or community access) bear 100% legal and operational responsibility for their offerings, fulfillment, customer support, and compliance with all applicable local and international laws.
You agree not to use Timber to distribute illegal items, copyrighted assets without authorization, malicious software, cracked content, stolen credentials, or fraudulent services. We maintain a zero-tolerance policy for malicious activity and reserve the right to ban offending servers immediately.
3. Platform Fees & Payout Schedules
All payments are securely processed via third-party processors (such as Stripe Connect). By selling on Timber, Vendors agree to our tiered platform application fees deducted at checkout:
- Free Tier: 5.0% platform fee per transaction (subject to micro-transaction surcharge).
- Pro Tier: 2.5% platform fee per transaction (subject to micro-transaction surcharge).
- Ultra Tier: 1.0% platform fee per transaction0% Surcharge • No Micro-transaction Limits
Monthly Free Tier Account Maintenance Fee: For Vendors on the Free Tier, the platform application fee on the first successful transaction of each calendar month will be the greater of the standard 5.0% commission or the local currency equivalent of $2.00 USD. This fee covers connected account maintenance and processor infrastructure costs. All subsequent transactions within the same calendar month will revert to the standard 5.0% commission.
Micro-Transaction Surcharge (Free & Pro Tiers Only)
For transactions below the regional equivalent of $10.00 USD (~9.00 EUR or ~45.00 RON) on Free and Pro tiers, a fixed platform surcharge equivalent to $0.50 USD is applied to cover baseline processor network overhead and fraud mitigation.✦ Ultra Tier members are fully exempt from this surcharge: payments are processed at a clean 1.0% platform rate regardless of transaction size.
Payout Settlement: Net vendor earnings are transferred on an automated weekly schedule to the Vendor's connected payout account, subject to standard anti-fraud rolling delays (typically 7 business days) enforced by payment networks.
4. Chargebacks, Disputes & Liability
Vendors are exclusively responsible for disputes, fraud claims, and chargebacks initiated by their buyers. In the event of a customer dispute or lost chargeback, Timber reserves the right to deduct or debit the disputed transaction amount along with any associated payment processor dispute fees directly from the Vendor's connected balance or future payouts.
5. Taxation & Legal Compliance
Vendors are solely responsible for determining, collecting, reporting, and remitting any applicable sales taxes, VAT, GST, or income taxes required by their respective legal jurisdictions. Timber does not provide legal or tax advice and disclaims all liability regarding non-compliance by Vendors.
6. Account Suspension & Termination
We reserve the right to suspend, restrict, or permanently terminate any account, connected payout route, or Discord bot integration without prior notice if we detect violations of these terms, excessive dispute rates, suspicious fraud patterns, or illegal activity.
7. Limitation of Liability
Timber is provided on an "as is" and "as available" basis without warranties of any kind. To the maximum extent permitted by law, Timber and its operators shall not be held liable for any indirect, incidental, or consequential damages, loss of profits, service interruptions caused by third-party APIs (such as Discord or Stripe), or disputes between buyers and Vendors.
